Introduction

It is often misunderstood as a form of punishment; however, in legal terms, suspension is generally a temporary administrative measure taken by an employer during the pendency of a disciplinary inquiry or investigation. It is used in both public and private employment to ensure a fair and unbiased inquiry process.
Meaning and Nature of Suspension
Suspension refers to the temporary removal of an employee from active duty while the employer-employee relationship continues to exist. It does not amount to termination, dismissal, or removal from service. The primary objective of suspension is to ensure that the employee does not interfere with the ongoing inquiry, tamper with evidence, or influence witnesses.
Legally, suspension is considered a precautionary and administrative step rather than a punishment. However, depending on the outcome of the inquiry, it may lead to disciplinary action such as dismissal or penalties if misconduct is proven.
Grounds for Suspension

Employers are expected to conclude inquiries within a reasonable time frame. In cases of unnecessary delay, the employee may seek legal remedies for revocation of suspension or appropriate relief from courts or tribunals.

In practice, suspension can significantly affect an employee’s reputation, mental well-being, and financial stability. Although it is not a punishment in itself, it is often perceived negatively in society. Delays in conducting inquiries are a common issue, leading to prolonged suspension periods despite payment of subsistence allowance.
Therefore, it is essential for employers to ensure that suspension is used only when necessary and that disciplinary proceedings are conducted efficiently and fairly to avoid misuse or hardship to employees.
